Rental Terms

Bookings
Upon agreement to the booking dates and total booking amount, the reservation shall be confirmed.

Payment
An initial deposit of 50% of the total booking amount is required to confirm the reservation.

The villa will not be considered reserved prior to receipt of the deposit payment.
If the deposit payment is not received within one week from the date of confirmed reservation, the reservation will be cancelled.

The balance payment must be received 30 days before the arrival date. If Santisook does not receive the balance payment until the due date, Santisook reserves the right to cancel the reservation and apply cancellation charges.
If the guests are staying for less than one week, full payment is required at the time of reservation.
If the booking is made less than 30 days of arrival, full payment is required at the time of reservation.

Security Deposit
Santisook requires the guest to pay a security deposit in cash upon arrival. The security deposit shall be refunded less any cost of any damage or breakage during the rental period of the guests. The security deposit may only be used for incidental expenses or other charges, only as agreed.

Utilities
The electricity, water, internet, cleaning, gardening and pool costs are included in the rates unless otherwise agreed.

Linen & Towels
Linen and towels are included in all the villas. They are changed every third day or twice weekly. If you require more frequent changes, extra charges apply. Outside laundry services are available with an additional service charge and must be paid in cash before laundry collection.

Toiletries
An initial supply of toiletries are provided.

Rates
The villa rental rates are on a per day basis and quoted in Thai Baht.

Guests
Upon reservation, the names of all the guests must be registered. These registered guests are the ones who shall reside at the villa. Santisook must be informed of any changes to the guest list. Should anyone whose name is not registered, resides at the villa, a rate of USD100 per person per day shall be charged. The number of guests staying at the villa must not exceed the maximum capacity specified, except in the case of infants (under two years old) or unless permitted by Santisook.

Booking Cancellation
You may cancel your reservation at any time by notifying us by email. The cancellation will take effect on the day we confirm the receipt of the email. The following cancellation terms apply: More than 30 days prior to arrival – forfeiture of the deposit Less than 30 days prior to arrival – forfeiture of the whole amount paid. Balance payment is not received 30 days before arrival – forfeiture of the deposit.

Santisook will charge an administration fee of US $50 for any change to the booking after a confirmation has been issued. In the unlikely event that Santisook has to make any changes to the confirmed bookings, we will advise you at the earliest possible date. If the reserved villa is damaged, rendered unusable, or if for any reason beyond our control, or due to unexpected circumstances that we are unable to provide you with the villa, Santisook shall reserve the right to cancel the reservation and refund the guest the payment in full, less any bank transfer charges. Santisook shall not be liable for any further obligations or claims by the guest.

Arrival & Departure Times
Check-in time is from 2 pm and checkout time is at 11 am unless otherwise agreed.

Exclusions & Additional Charges
Airport transfer on departure is not included but can be arranged. Villa rate does not include baggage handling, gratuities, telephone, fax and telegram charges, car rental, food, soft drinks, liquor, personal items and expenses, and any excessive cleaning required upon departure (such as upholstery or rug shampooing etc) or replacement of breakages. Fair wear and tear is accepted.

Rules
Santisook reserves the sole and exclusive right to request any guest to vacate the estate in the event of the fol1owing: male or female joiners are invited over to the villa, as non registered guests; any illegal activities with under-age individuals are witnessed (guests would be summoned to the local police); any other illegal or immoral activities are done within the villa. No refund shall be given after such an incident.
No pets are allowed. Firearms, deadly weapons, pyrotechnics/ fireworks, prohibited drugs, and gambling are not permitted.

Insurance
It is a condition of the booking that the entire party is covered by a comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including local treatment, evacuation and repatriation coverage) of their own. As deposits and rental payments may not be refundable after a reservation has been confirmed, you should consider an option of this travel insurance to cover the loss of money paid to the villa in case you might have to unexpectedly cancel your journey. Santisook, the management and the villas owners shall not be responsible and shall be held harmless by you and your party against any and all claims including any accidents related to the use of the villa facilities or locally procured third party services such as, but not limited to, watercraft, water sports, car or motorbike rental. Santisook, the management and villa owners shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside their control, such as civil disturbances, fires, floods, severe weather, acts of God etc… By acceptance of this contract, it is assumed by Santisook, the management and the villas owners that this requirement will be complied with in full.

Liability Release
Under no circumstances shall Santisook be responsible for any loss, expense, damage, claim or injury either directly or indirectly, consequential or otherwise whatsoever, caused or incurred, whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodation as described or substituted, or by reason of military action, revolution or acts of God, or by any agents, employees, subcontractors, servants or third parties whatsoever supplying any of the services or accommodation herein or as substituted.

Complaints
Santisook accepts no responsibility for the following: any modifications made by the villas owners which are not mentioned on the web page or anywhere else; the breakdown of the supply of water or electricity or swimming pool filtration systems. However, shall you contact us during such problem, we will use our best endeavor to arrange for any such problems to be solved quickly. Any complaints must be notified to Santisook within 24 hours of the occurrence giving rise to the complaint. Should a problem remain unsolved, please make a complaint in writing to Santisook within 14 days of the completion of the rental period. If the villa is vacated before the end of the rental period without mutual agreement, this may result in the loss of all rights to compensation. No claim can be made after the villa has been vacated if notification at the time of the problem’s occurrence was not made to Santisook.

Conduct & Behavior
The person making the reservation is held responsible for the correct and appropriate behavior of the guests staying at the villa. Should any member of the party not behave in such a manner, Santisook may at their absolute discretion ask the offending guest/s to vacate the villa.

Staff
Santisook includes the service of one or several staff. Santisook assumes no liability for contracted staff such as car drivers etc…

Valuables
Santisook has a safe in one of the bedrooms for the guests. Santisook, the management, villa owners and the staff are not to be held responsible for the loss or damage of valuables. The guest shall leave their valuable at the villa or in the safe at their own risk.

Due Care of the Facilities
Guests are required to take due care when residing at the villa, especially with the children playing in the gardens, the road, and or the pool. Guests are reminded to be cautious when the floor is wet, the floors can get slippery. Damage or injury arising shall not be the responsibility of Santisook, the management and villa owners in any way whatsoever. The handling of furniture, crockery and other artifacts shall be done with maximum care.

Applicable Law
These conditions and any contract to which they apply are governed in all respects by the applicable Thai law, and the Thai courts only shall have jurisdiction in relation to any claim or dispute arising out of, or connected with them.
